Amy Metcalfe likes to has fun like everyone else, but she takes her job very seriously, she is a dedicated hard worker who’s main focus at Hochman and Plunkett is Personal Injury. Amy has been in the litigation field for over ten years.
After meeting Amy, you’ll see that she’s very tough, smart, fair, and she really cares about her clients’ rights and needs. She has the focus, drive, and courtroom brains that any client would want in their lawyer.
Outside of work, Amy volunteers at TWIGS, which is an organization that holds activities that support the Children’s Medical Center in Dayton.
Amy speaks about a case that was special to her:
We work as a team at Hochman and Plunkett which effectively results in a “two heads are better than one approach” to litigating a personal injury case. In this particular case, we represented an eight year-old little girl and her parents in a personal injury case resulting from a bb gun shot injury to her chest. She was accidentally shot with a bb gun by another little girl while all of the children were in care of the neighbor. The bb gun was negligently left in the yard where the children were playing. This case was rejected by another large personal injury firm in the Dayton area.
As a result, these clients came to Hochman & Plunkett. Because of the nature of the injury to a child so young, we were very interested in representing this family. We investigated the facts and circumstances of the injury, reviewed the applicable insurance coverage policies, and researched the case law that effected our theory of liability and the available insurance coverage. We wasted no time in compiling the medical evidence and filed a lawsuit into Court when the insurance company refused to accept liability for this serious injury to our young client. We conducted depositions of the parents and the children who were witnesses to this accident. We took time to research the insurance policy and all theories of liability so that our client would be compensated for her serious injury. We aggressively pursued this case by analyzing every detail from each witness’ testimony, we overcame stonewalling from the police agency who investigated the bb gun accident, and we secured expert testimony from the pediatric cardiologist who provided the care and treatment for our young client.
This story has a happy ending. We forced the insurance company to accept liability and compensate our young client for her injury. She received enough settlement money to cover her medical bills, compensate for her pain and loss of quality of life. Most importantly, however, was the fact that she recovered nicely from her injuries and she has a substantial trust account that will pay for her future college education.
